1 Scope of application
For the business relationship between eversmart products GmbH and the customer, the following General Terms and Conditions apply exclusively in the version valid at the time of the order. Deviating conditions are not recognized.
2 Conclusion of contract
- The following terms and conditions regarding the conclusion of contracts apply to orders placed through our online store at https://ashwagandha.ch/agb
- If the contract is concluded, the contract is concluded with eversmart products GmbH, Isenrietstrasse 19, 8617 Mönchaltorf, registration number (UID): CH-159.620.861 Register court: Commercial Register Office of the Canton of Zurich.
- The presentation of the goods in our online store does not constitute a legally binding contractual offer on our part, but is merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.
- When an order is received in our online store, the following rules apply: The consumer submits a binding offer to enter into a contract by successfully completing the ordering process provided in our online store. The ordering process consists of the following steps: 1) Select the desired items 2) Confirm by clicking the “Order Now” button 3) Review the details in cart ) Click the “Proceed to checkoutbutton 5) Log in to the online store after registering and entering your login credentials (email address and password). 6) Review and correct the entered information as needed. 7) Submit the binding order by clicking the “Place Order” or “Buy” button Before submitting the order, the consumer may return to the webpage where customer information is entered by clicking the “Back” button in their web browser after reviewing their details, in order to correct any input errors or cancel the ordering process by closing the web browser. We will immediately confirm receipt of the order via an automatically generated email (“Order Confirmation”). With this, we accept your offer. (5) Storage of the contract text for orders placed through our online store: We will store the contract text and send you the order details and our Terms and Conditions via email. You can also view the Terms and Conditions at any time at https://ashwagandha.ch/agb.
3 Returns
Returns without the prior consent of eversmart products GmbH will not be accepted. Returns that have not been agreed will be sent to the customer again and the new shipping costs will be added to the invoice amount. Based on the Swiss Code of Obligations, Art. 184 ff. OR, we do not grant any right of withdrawal.
4 Delivery
- Unless we have clearly stated otherwise in the product description, all items offered by us are ready for immediate dispatch. Delivery will be made within 2 working days at the latest. In the case of payment in advance, the delivery period begins on the day after the payment order is sent to the bank responsible for the transfer and for all other payment methods on the day after the contract is concluded. If the deadline falls on a Saturday, Sunday or public holiday at the place of delivery, the deadline shall end on the next working day.
- The risk of accidental loss and accidental deterioration of the item sold shall not pass to the buyer until the item is handed over to the buyer, even in the case of sale by dispatch.
5 Due date and payment, default
The goods are shipped on account or with one of the other specified payment options. The customer pays the purchase price without postage costs to the business account of the recipient stated on the invoice - eversmart products GmbH. If the customer is in default of payment, eversmart products GmbH is entitled to demand a lump sum for default in the amount of SFr.20,00. If, after several reminders, no payment is received from the customer on the account of eversmart products GmbH, we reserve the right to collect the debt.
6 Special features when buying on account
Payment on account is only possible for consumers over the age of 18. The outstanding invoice amount is due upon receipt of the goods and invoice.
7 Retention of title
We reserve title to the goods until the purchase price has been paid in full.
8 Warranty
The statutory warranty regulations of Switzerland apply.
9 Contract language
The contract language is exclusively German.
10 Collection, processing and use of our customers' personal information

11 Exclusion of liability for damage to health
No damage to health is known or to be feared if used properly and for the intended purpose. eversmart products GmbH accepts no liability or warranty for damage of any kind. Products contain small parts and must be kept away from children. Do not swallow products. You are often the best doctor. Inform yourself in advance about any intolerances or allergies and do not use our products if in doubt.
12 Applicable law
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Zurich.
